Do I qualify for Chapter 7?

Chapter 7 bankruptcy is usually referred to as a “full bankruptcy” or “complete bankruptcy.” Chapter 7 bankruptcy will eliminate your debt and you will likely be able to keep all of your property. • Based on your income, expenses, and debt burden, you could feasibly complete a Chapter 13 repayment plan.

Under the 2005 bankruptcy code amendments, the first step in figuring out whether you can file for Chapter 7 is to measure your "current monthly income" against the median income for a family of your size in your state. In Wisconsin, the median income for a family of four is approximately $71,000.00 as of January 2007. The large majority of people considering Chapter 7 bankruptcy have an income below the median, and therefore, Chapter 7 can eliminate much of their debt.
